Clarity Health Intelligence Data Use Agreement
By using Clarity Health Intelligence, Inc.'s ("Clarity") website and the Clarity application (the “App”), you acknowledge and agree to the following regarding the collection, use, and sharing of all information provided by you.
1. Information You Provide
You may choose to provide information about yourself and others whose health you support, and/or about whose health you are concerned (e.g., a family member or pet). This may include health-related information, observations, medications, care activities, and other personal details.
You represent and warrant that you have the appropriate authority and consent to share any information about another individual through the App.
2. Purpose of Data Use
Clarity can use your information to:
- Help you organize and manage health-related information in one place, which use is limited to you and those you authorize to access the data.
- Enable insights, reminders, and care coordination for you and those you authorize to have access. In addition, Clarity may use your data, on an anonymized basis, to help others manage their health-related information.
- Generate summaries for your use and those you authorize to access summaries you generate.
- Power Clare, our AI assistant, to respond to questions and assist with care management for you and, on an anonymized basis, to others.
Your data helps transform day-to-day caregiving observations into structured, actionable insights.
3. Use of Artificial Intelligence (Clare)
Clare is an AI-powered assistant developed by Clarity which is designed to help you navigate caregiving tasks, surface insights, and answer questions.
By using Clare, you understand and agree that:
- Responses are generated using artificial intelligence and may not always be complete, accurate, or up-to-date, or specific to you and your situation.
- Clare is intended for informational and support purposes only, does not provide medical advice, diagnosis, or treatment, and should not be relied on for such purposes.
- You should always consult a qualified healthcare professional for medical decisions.
4. Data Sharing and Disclosure
We do not sell your personal data.
We may share information in the following ways:
- Pursuant to your direction: For example, sharing personal identifiable information (“PII”) with members of your care circle or healthcare providers.
- Service providers: With trusted third parties who support our platform (e.g., hosting, analytics), under strict confidentiality obligations, and on an anonymized basis.
- De-identified data: We may use aggregated and de-identified data to improve our services, develop insights, and support research or partnerships.
- Pursuant to legal requirements: When required to comply with applicable laws, regulations, or legal processes.
5. De-Identification and Data Intelligence
Clarity Health may remove identifying information from your data and combine it with other data to:
- Improve care models and predictive insights.
- Identify trends in caregiving and health outcomes.
- Support healthcare innovation and research.
As a condition to such use, this data will be modified so that it cannot reasonably be used to identify you.
6. Data Security
We implement reasonable administrative, technical, and physical safeguards to protect your information. However, no system can be guaranteed to be completely secure.
You are responsible for maintaining the confidentiality of your account credentials.
7. Your Control and Choices
You maintain control over your data. You may:
- Access and update your information.
- Choose what information to share and with whom.
- Disconnect integrations (e.g., patient portals, care team sharing).
- Request deletion of your data, subject to legal and operational requirements.
8. Non-Confidential Communications
Any feedback, suggestions, or ideas you submit to Clarity may be used without restriction or compensation to you.
9. Changes to This Agreement
We may update this Data Use Agreement from time to time. Continued use of the App after updates constitutes acceptance of the revised terms.
